TERMS AND CONDITIONS

1   INTRODUCTORY PROVISIONS

1.1

These general terms and conditions (hereinafter as the “GTCs“) apply to accommodation services provided by the provider PABY s.r.o., Identification No. (IČO): 35797797, Boleráz 407,91908, registered  with the Commercial Register of the District Court Trnava, Section: sro, insert No.: 12351/T, hereinafter as the “guesthouse“.

1.2

The client is advised in their own interest to get acquainted with these GTCs before making a reservation. The provider of the guesthouse reserves the right to unilaterally change these GTCs; such amendment of the GTCs is effective from the day of their publishing on the website of the provider of the guesthouse. If the client does not agree with some of the provisions of these GTCs, the provider of the guesthouse asks them not to use the services of the provider of the guesthouse. By confirming the reservation, the client expresses unconditional consent to these GTCs.

2 RESERVATION AND ACCOMMODATION SERVICES

2.1

Reservation can be made via the reservation form, by phone or in person at the guesthouse.

2.2

The guesthouse is obliged to prepare and make the reserved rooms available to the client from 2 p.m. on the agreed day of arrival; the client has the right to provide the reserved room before the specified time only if the guesthouse agreed to this when confirming the reservation. The guesthouse is entitled to leave the reserved rooms to another client if the client did not take them over by 10 p.m. at the latest on the date of arrival; this does not apply if a later arrival of the client has been expressly agreed upon.

2.3

When moving into the room, the client is obliged to report to the guesthouse reception any possible deficiencies, discrepancies or reservations immediately after discovering them. They are also obliged to proceed if they discover any damage to the room, its equipment or inventory. If the guesthouse discovers damage to the room or its inventory after the end of the client’s stay, without the client reporting these facts to the guesthouse reception, the client is obliged to compensate the guesthouse for such damage in full.

2.4

The client is obliged to vacate and leave the room no later than 10 a.m. on the agreed day of departure, unless otherwise agreed in advance. If the client hands over the room after this time, but no later than 12 p.m., the guesthouse is entitled to charge a fee of 50% of the accommodation price (so-called late checkout) and after 12 p.m. the full price of accommodation for the following night. The hotel reserves the right to change the time of the check-out to time before 10 a.m., of which it is obliged to inform the client immediately (by e-mail, telephone or in person). If, based on this change, the client decides to cancel their reservation, the guesthouse will not claim a cancellation fee.

2.5

The guest can cancel the reservation free of charge up to 3 days before arrival. The guest will pay 100% of the price of the first night if the reservation is cancelled later than 3 days before arrival. The guesthouse reserves the right to pre-authorize the card and block the amount for the first night. The pre-authorized amount remains on the client’s account and is released after paying for the stay. In case of cancellation of the reservation according to the cancellation terms, the amount will be released within 7 days from the cancellation or according to the bank’s terms.

2.6

Unless excluded by the nature of the matter, the provisions of this article of the GTCs also apply to the accommodation terms for groups. In such case, the accommodated guest and the person who made the group reservation are jointly and severally responsible for the obligations towards the guesthouse.

2.7

Guests who reserve a room larger than their number will be rebooked to a room corresponding to their number.

3 PAYMENT TERMS

3.1

For the accommodation and services provided, the client is obliged to pay the price in accordance with the valid price list of the guesthouse, but no later than on the day of the end of the stay based on the submission of the bill or invoice together with the account of advances provided by the client. For a stay longer than seven days, the client is obliged to pay for the entire stay no later than the seventh day of the stay, unless the guesthouse and the client have agreed otherwise. Bill or invoice for the stay is due at its submission to the client.

4 WITHDRAWAL FROM THE CONTRACT

4.1.

Each contracting party may withdraw from the contract for the reasons expressly stated in the contract.

4.2.

The guesthouse is entitled to withdraw from the contract also for the following reasons, unless these, or some of them, are expressly excluded in the contract as reasons for withdrawal:

  1. a) such entitlement was agreed in writing with the client;
  2. b) the client does not insist on performance by the guesthouse;
  3. c) there is more than 90 days before the planned start of the provision of the services;
  4. d) circumstances, for which the guesthouse is not responsible and which make the fulfilment of the contract impossible, have occurred;
  5. e) the client has obligations towards the guesthouse after the due date;
  6. f) advance payment or deposit were agreed upon when making a reservation and the client did not fulfil their obligation on time;
  7. g) services were ordered or reserved providing incorrect, misleading, false or truth-distorting data about the client or other essential facts;
  8. h) the guesthouse has a justified reason to believe that the use of the hotel services could threaten the proper operation of the guesthouse, the security of the guesthouse, its employees or clients, damage the good name or respectability of the guesthouse in public, without this being legitimately attributed to the owner, or the managing bodies of the guesthouse.
  9. i) smoking and cooking are prohibited in the rooms. In case of violation, the stay will be terminated and a fine of EUR 50 will be charged.

5 FINAL PROVISIONS

5.1.

These GTCs and legal relationships established on their basis are governed by the laws of the Slovak Republic.

5.2.

Should any provision of these GTCs be or become invalid, ineffective, or unenforceable, such invalidity, ineffectiveness or unenforceability does not affect the validity and effectiveness of other provisions of these GTCs.

5.3.

When confirming the reservation, the client expresses their consent to these GTCs and undertakes to comply with them. The provider of the guesthouse reserves the right to change these GTCs. The obligation of written notification of changes to the GTCs is fulfilled by placing the changed GTCs on the website of the guesthouse provider https://penzionpodzamkom.upvision.site/ and in the premises of the guesthouse in a visible place.

5.4.

These GTCs become valid and effective on 1 March 2023.
